In 2012, the Turkish Parliament issued a decision granting all foreigners residing inside or outside Turkey the right to own real estate and inherit it, except those holding Syrian nationality and four other nationalities: Armenian nationality, Cypriot nationality, North Korean nationality, and Cuban nationality.
As for Syrians holding Turkish citizenship, they have the full right to own and dispose of their property, without any obstacles or requirements, like any Turkish citizen, according to the circular issued by the Presidency of the Foreigners Department of the General Directorate of Land Registry and Land Survey in Turkey on November 16, 2021.
A Syrian who holds a nationality other than Turkish, such as German or American, for example, is treated like a Syrian citizen and is not entitled to own real estate in Turkey, regardless of his other nationality, as Turkish law views him according to his original nationality in this case.
As for Syrians holding other nationalities who owned real estate in Turkey before the issuance of the latest amendments, they will be treated according to the second nationality they hold, and they will not face any problems, unless they sell their real estate registered with the second nationality, as they will not be able to buy new real estate again.
Experienced people and lawyers working in the Turkish real estate sector were able to find some solutions that allow Syrians who do not have Turkish citizenship to buy homes and own real estate in Turkey through legal means after the issuance of ownership ban decisions.
The option of owning real estate by establishing a company in Turkey is considered one of the most effective ways that enable you to buy real estate under the name of the company that you established, and you have the right to use, invest, and sell the property like any investor because you represent the company before the Turkish government. But there are also exceptions, as in this case the buyer does not obtain real estate residency in Turkey nor can he apply for Turkish citizenship through real estate investment, even if the price of the real estate he purchased in the name of his company exceeds the limit of $400,000.
A Syrian citizen can establish a company without the condition of having a Turkish partner, and accordingly, the company obtains a Turkish legal personality that enables it to own real estate and practice commercial, industrial, and agricultural activities without any restrictions.
It is noteworthy that establishing a company to own Syrians in Turkey does not require a lot of time and effort. Rather, a few hours in just two days are sufficient for that, and then the Syrian investor obtains the tax number and commercial register and ends with opening a special bank account in the name of the company.
So what are the papers required to establish a company in Türkiye?
The first step to be followed is to apply to establish a company, followed by a set of papers obtained through law firms and specialized services, which are sequentially as follows:
-Request to establish a company.
-Two copies of the passport and personal identity card, duly translated and certified.
-Three personal photos.
-The company’s articles of incorporation + statement of incorporation.
-Signature statement from the company owner.
- Certified copies of other foreign documents, if any.
-Bank payment receipts.
-Commercial register statement.
-Tax number document.
Stages of establishing a company in Türkiye

The first stage
In the first stage, the company owner meets with the chartered accountant to agree and establish the foundations on which the company operates. The chartered accountant provides legal advice to prevent the company owner from running into problems or violations.
Then the company’s articles of incorporation are signed, which clarifies the owner’s authority and identity, the authority of the employees, and the company’s activities.
The second phase
The company is registered with the Tax Department, and a company tax number is obtained. Here the company becomes an independent entity, and Syrians can now buy a property in Turkey through it.
The third level
An account is opened in a Turkish bank and a capital of no less than 1,000 Turkish liras is deposited in the account.
The fourth stage
The final stage is signing in the presence of a notary, and after signing, the owner of the company becomes its official owner in Turkey.
Establishing a company in Turkey does not require more than several days, perhaps only two days, and the company becomes an independent person with a bank account and is also registered in the Turkish Commercial Register.
